By creating an account, browsing listings, or using the comparison tools on the Sledmart website or our associated mobile applications (collectively, the "Service"), you agree to these Terms of Service. If you do not agree to all the terms and conditions, you must stop using the Service immediately.

2. Description of the Marketplace

Sledmart acts exclusively as an online venue connecting snowmobile buyers, private sellers, and official dealers. Sledmart is not a party to any transaction between users. We do not own, inspect, or guarantee the condition, safety, or legality of any snowmobiles listed on the platform. Any purchase or sale is solely at your own risk.

3. User Accounts and Content

• You must provide accurate and up-to-date information when creating an account or a listing.
• You are responsible for all activity that occurs under your account.
• You grant Sledmart a non-exclusive, worldwide, royalty-free license to display the listings, images, and descriptions you upload to the platform.
• We reserve the right to remove any listing or terminate any account that violates these terms, is fraudulent, or contains inappropriate content.
• Zero Tolerance Policy: There is no tolerance for objectionable content or abusive users. We reserve the right to remove any listing or terminate any account that violates these terms, is fraudulent, contains inappropriate or offensive content, or engages in abusive behavior.

4. Platform Accuracy and Specification Disclaimers

Sledmart provides highly detailed snowmobile manufacturer specifications, including dimensions, suspension travel, and engine details. While we strive for accuracy, Sledmart makes no warranties regarding the completeness or reliability of these manufacturer specifications or the details provided by individual sellers.

5. Performance Calculator Safety Warning

Sledmart features tools that calculate estimates based on user-provided variables, such as rider weight, luggage weight, and fuel load. These tools are for informational and comparative purposes only.

• Sledmart's calculations do not replace official manufacturer safety guidelines.
• Relying on these calculations for suspension tuning, load limits, or mechanical setup is done strictly at your own risk.
• Always consult your vehicle's official owner's manual and a certified mechanic to ensure safe operating limits.

6. Limitation of Liability

To the maximum extent permitted by applicable law, Sledmart (and its founders, affiliates, and developers) shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to personal injury, property damage, loss of profits, or data loss, resulting from:

• Your access to or use of the Service.
• Any transaction or physical meeting initiated through the platform.
• Reliance on any vehicle specifications, performance calculations, or advice found on the platform.

*Note for EU Consumers: Nothing in these terms excludes our liability for gross negligence, willful misconduct, or your statutory consumer rights under EU law.

7. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Sledmart's principal operations are headquartered, without regard to its conflict of law provisions. If you are an EU consumer, you additionally enjoy the protection afforded to you by mandatory provisions of the law of your country of residence.

8. App Store Platform Terms

If you access or download our mobile application from the Apple App Store or Google Play Store (each an "App Store"), you acknowledge and agree that:

• These Terms are concluded between you and Sledmart, and not with the App Store. Sledmart, not the App Store, is solely responsible for the Service.
• The App Store has no obligation whatsoever to furnish any maintenance and support services with respect to the app.
• The App Store is not responsible for addressing any claims you have relating to the app or your possession and use of the app, including product liability claims, consumer protection claims, or intellectual property infringement claims.
• Apple and Apple's subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right to enforce these Terms against you as a third-party beneficiary.
